Information on the processing of personal data

Pursuant to Article 13 of Regulation (EU) No. 679/2016 (hereinafter “GDPR”), containing provisions for the protection of individuals and other subjects with regard to the processing of personal data, you provide your personal data or personal data of third parties that you have legitimate access to to FRIGERIO VIAGGI S.r.l. (hereinafter “FV”), which provides you with the following information regarding the purposes of personal data processing

to propose, organize, and provide services in support of business travel that require the communication of personal data to airlines, car rental companies, hotels, insurance companies, tour operators, and other third-party operators that provide services or perform activities in accordance with contractual relationships with Frigerio Viaggi;
for the acquisition of personal information through the implementation of appropriate technical and administrative procedures, including data relating to payment systems (e.g., relating to credit or debit cards) to be used between interacting systems in encrypted mode, with protection by firewalls and security systems designed to prevent unauthorized access to such data;
for the organization of a tourist package or for the provision of individual tourist services;
for the purchase of related tourist services at favorable conditions;
for brokering the purchase of a tourist package organized by third parties or
the purchase of individual tourist services provided by third-party operators (e.g., hotels, carriers, etc.);
for brokering the purchase of ancillary financial/insurance services and services related to tourist packages/services on favorable terms or purchased individually (health/luggage insurance policies; cancellation coverage, assistance for travelers in difficulty, consumer credit);
for the performance of obligations related to the issuance of visas;
to register on our website and/or app or to fill in the forms on the website or app.
For the purposes of purchasing tickets for amusement parks, full reference is made to the terms and conditions of sale specified in the respective offers.

Purpose and legal basis of processing

Pursuant to Articles 9 and 10 of the GDPR, you acknowledge that, as a result of the negotiation and/or conclusion and/or execution of the contract, data falling within the definition of “special categories of personal data” may be communicated to FV, i.e., data previously defined as sensitive, revealing "racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data intended to uniquely identify a natural person, or data concerning health or sex life or sexual orientation" or data relating to your habits and/or practices and
customs connected with travel needs or the use of the tourist service.

a) Finalità connesse all’esecuzione contrattuale. I Suoi dati personali saranno trattati per adempiere agli obblighi connessi alla negoziazione e stipula dei contratti necessari alla fornitura dei servizi, o per l’adempimento di obblighi derivanti da tutti i rapporti contrattuali, inclusa la fase precontrattuale, come sopra indicato, al fine di consentire a FV la corretta erogazione del servizio. In particolare, i dati saranno trattati
per le seguenti attività:

establish, manage, and execute contractual relationships, including the aforementioned intermediation;
meet the requests made by interested parties;
communicate notices relating to purchased services or other additional and ancillary services (e.g., information relating to purchased services; changes to contractual terms and conditions; cancellations, refunds, etc.).

b) Purpose of the law. Your personal data will also be processed for:

ensure compliance with legal obligations, regulations, national, European Union, and international laws, or obligations arising from orders issued by legitimate authorities in accordance with the law;
ascertain, exercise, and/or defend, in the event of any dispute, including legal proceedings, a right of FV;
comply with tax and accounting obligations;
comply with obligations under legislation on passenger safety and health;
comply with obligations under legislation on the transport of passengers and goods.

c) Purposes related to business activities and statistics. Your personal data will also be processed for purposes related or relevant to the activities carried out by FV and to compile anonymous statistics and market research.

d) Additional purposes. Furthermore, subject to your express consent, your personal data will be processed for the following purposes:

Marketing purposes, which include:

FV promotional activities carried out both automatically (e.g., email, SMS, instant messaging applications, etc.) and non-automatically (e.g., regular mail, operator phone calls, etc.). In particular, FV may use your email address or other contact details provided by you when submitting data or purchasing tourist packages or services to send you information and promotional communications relating to similar services and products offered by FV, unless you object to the use of such contact details.
Profiling, i.e. analysis of your travel preferences and market research, in order to improve the services and commercial information offered by FV or, in any case, to tailor them to your interests. This
activity may also be carried out through satisfaction questionnaires and/or through the use of profiling cookies while browsing our
websites and apps.

d) Additional purposes. Furthermore, subject to your express consent, your personal data will be processed for the following purposes:

Marketing purposes, which include:

Promotional activities by FV's commercial partners, carried out both automatically (e.g., email, SMS, instant messaging applications, etc.) and non-automatically (e.g., regular mail, operator phone calls, etc.). In particular, FV's commercial partners may use your email address or other contact details provided by you when submitting data or purchasing tourist packages or services to send you information and promotional communications relating to similar services and products offered by them, even without your consent, without prejudice to your right to object to the use of such communications.

Processing carried out for marketing purposes (i.e., promotional or profiling activities) may be performed provided that you have given your consent.

Type of data collected and consequences of refusal

The provision of your personal data is optional; however, failure to provide the data requested for the purposes indicated in points a) and b) (contractual and legal purposes) will make it impossible to provide, in whole or in part, the requested service. The provision of optional data will allow FV to improve the services offered in order to make them increasingly responsive to the personal interests of customers.
The provision of sensitive/special category personal data is voluntary; however, failure to consent to processing may mean that FV is unable to fulfill certain legal obligations related to the execution of the contract. The provision of sensitive/special personal data is voluntary; however, if you do not consent to the processing of such data, FV may not be able to fulfill certain legal obligations related to the performance of contractual services.

Categories of recipients of personal data

Your data will not be disclosed. It may be communicated, exclusively for the purposes mentioned above, to the following categories of recipients, natural or legal persons:

FV internal staff acting as data processors and/or data controllers;
suppliers of tourist services included in packages sold or suppliers of individual services purchased from FV;
Foreign countries for which the European Commission has adopted an adequacy decision pursuant to Article 45 and/or adequate safeguards pursuant to Article 46 of Regulation (EU) 2016/679, namely: Andorra, Argentina, Australia, PNR, Canada, Faroe Islands, Guernsey, Isle of Man, Israel, Jersey, New Zealand, Switzerland, and Uruguay;
suppliers and third parties, including in countries outside the European Union, for the purpose of making travel reservations (hotels, airlines, sales operations, back office, charter flight and distribution line negotiations, assistance, and administration);
external managers and third parties authorized to process and manage travel arrangements, who are properly appointed and trained in the processing of personal data;
insurance and financial companies that provide coverage and ancillary services related to the tourist packages and services purchased;
individuals, companies, associations, and professional firms that provide services or assistance and advice to FV for the protection of its rights (e.g., accountants, lawyers, tax advisors, auditors, consultants in auditing or due diligence operations, etc.);
individuals, companies, or agencies that provide FV with marketing and analysis services or consulting;
all parties whose access to your data is recognized by legal provisions and regulations or by orders from legitimate authorities, including airport, port, customs, and border authorities.

Transfer of personal data outside the European Union

Your personal data may be transferred abroad to other companies, whether or not they belong to European Union member states, provided that this is for the purposes indicated above. If your data is transferred to countries outside the European Union, FV will first verify compliance with applicable data processing regulations and the existence of guarantees that allow for an adequate level of protection for individuals, based on assessments carried out by the European Commission or, alternatively, FV will ensure that the recipient is contractually obliged to protect the data with a level of protection that is adequate and comparable to that required by the GDPR.

Retention of personal data

Personal data will be stored for a period not exceeding that necessary to achieve the purposes for which it is collected and subsequently processed. Personal data will be stored for the entire duration of the contract concluded with you and also for a subsequent period:

in accordance with the terms of applicable legislation;
in accordance with the terms set forth in the legislation, including secondary legislation, which requires data retention (e.g., tax returns);
for the period necessary to protect the rights of the data controller in the event of any disputes relating to the provision of services.

Personal data collected and processed for profiling purposes will be stored for no longer than ten (10) years, after which it will be automatically deleted or made permanently anonymous.

Data Controller and Data Protection Officer (DPO)

The Data Controller is FRIGERIO VIAGGI S.r.l., with registered office in Giussano (MB), Via Ambrogio Viganò no. 5, represented by the Chairman of the Board of Directors and legal representative, Mr. Giancarlo Frigerio. With regard to the processing of travelers' data, FV has appointed a Data Protection Officer (DPO), whose contact details are as follows, to enable travelers to exercise their rights under the legislation on the processing of personal data:

Rights of the data subject

At any time, pursuant to Articles 15 to 22 of the GDPR, you have the right, also with regard to profiling, to:

ask the data controller for access to your personal data and information relating to it; the correction of inaccurate data or the integration of incomplete data; the deletion of personal data concerning you (if one of the conditions indicated in Article 17, paragraph 1, of the GDPR applies and in compliance with the exceptions provided for in paragraph 3 of the same article); restriction of the processing of your personal data (in the event of one of the cases indicated in Article 18, paragraph 1, of the GDPR);
request and obtain from the data controller – in cases where the legal basis for processing is the contract or consent, and processing is carried out by automated means – your personal data in a structured, commonly used, and machine-readable format, including for the purpose of transmission to another data controller (known as the right to portability);
object at any time to the processing of your personal data if there are particular situations that concern you;
revoke your consent at any time, limited to cases where the processing is based on your consent for one or more specific purposes and concerns common personal data (e.g., place and date of birth or place of residence) or special categories of data (e.g., data revealing racial origin, political opinions, religious beliefs, or sex life). The lawfulness of the processing based on the consent given prior to the revocation remains unaffected;
lodge a complaint with a supervisory authority (Data Protection Authority www.garanteprivacy.it.

For each scheduled trip, all participants must be at the meeting point at least 10 minutes before the departure of each leg, with a printed voucher (when required) or reservation number.
If a visa is required, customers must obtain all necessary travel documents from their embassies or consulates before the start of the tour.

Frigerio Viaggi is not responsible for cancellations or unforeseeable circumstances, such as closures of museums, churches, monuments, or serious conditions due to traffic jams and/or public demonstrations.
Frigerio Viaggi is not liable for any harmful events, such as personal items lost or forgotten on our vehicles, or for any damage to persons or property caused by external parties.
All travel itineraries, including schedules and sightseeing tours, are subject to change due to unforeseen traffic congestion or changes in the program organization, in order to ensure a better experience.
Once the travel documents have been issued (approximately 7 days before departure), a 100% penalty will be charged in case of cancellation.
Radio guides must be returned at the end of the tour; otherwise, visitors will be charged €70.00 for each device not returned.
Minors must be supervised by their parents or legal guardians. For complaints or reports, please write to incoming@frigerioviaggi.com Prices must be reconfirmed based on availability at the time of booking.
